TERMS AND CONDITIONS, CANCELLATION & REFUND POLICY

These Terms and Conditions (“Terms”) govern your access to and use of the ParkIn Valet mobile application, digital platforms, and related services (collectively, the “Platform”) provided by Smart Way Group in the Kingdom of Saudi Arabia (“KSA”).
By downloading, registering, accessing, or using ParkIn, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you must immediately stop using the Platform.
1. Definitions
For the purpose of these Terms:
- Smart Way Group, “We”, “Us”, or “Our” refers to the Saudi-registered company providing the ParkIn technology platform and related digital services.
- ParkIn refers to the ParkIn mobile application, systems, platform services, and related digital solutions.
- User, “You”, or “Your” refers to any individual or legal entity using ParkIn.
- Parking Operator refers to any third-party entity authorized to own, manage, operate, or supervise parking facilities.
- Authority refers to any government, regulatory, municipal, or enforcement body in KSA.
- Services refers to digital parking discovery, reservation, access, payment facilitation, monitoring, support, and related features.
2. Scope of Services
2.1 ParkIn is a smart mobility and parking management platform designed to support:
- Parking discovery and navigation
- Parking reservation (where available)
- Entry/exit access control (where integrated)
- Payment processing facilitation
- Monitoring, reporting, and analytics
2.2 Smart Way Group provides the technology platform and integration. Parking facilities are owned, managed, and operated by Parking Operators unless explicitly stated otherwise.

2.3 ParkIn may include advanced features such as:
- Real-time availability
- Dynamic pricing
- Digital enforcement support
- AI-driven analytics
- Integration with smart city and Authority systems
2.4 Certain services may be available only in selected cities, zones, or facilities, and may vary based on Parking Operator policies or Authority requirements.
3. Eligibility and Registration
3.1 You must:
- Be at least 18 years old, and
- Be legally competent under applicable Saudi laws.
3.2 You must provide accurate, complete, and up-to-date information during registration, including but not limited to:
- Name and contact details
- Vehicle information
- National ID / Iqama (if requested for verification)
3.3 You are responsible for ensuring your vehicle and personal information remains correct at all times.
3.4 Smart Way Group reserves the right to verify User information and may reject, suspend, or terminate accounts that provide inaccurate, misleading, or fraudulent data.
4. User Responsibilities
4.1 You agree to use ParkIn strictly in compliance with:
- Applicable Saudi laws and regulations
- Parking regulations and municipal rules
- Facility-specific rules and signage
- Instructions issued by Parking Operators or Authorities
4.2 You must respect:
- Time limits
- Entry/exit rules
- Reserved slot conditions
- Enforcement requirements

4.3 You must not:
- Manipulate bookings, pricing, or reservations
- Attempt unauthorized access to systems
- Interfere with Platform security
- Use ParkIn for unlawful activities
4.4 Any misuse may result in penalties, suspension, termination, and/or legal action.
5. Account Security
5.1 You are solely responsible for maintaining the confidentiality of your login credentials, OTP access, and registered mobile number.
5.2 All activities performed through your account will be treated as authorized by you.
5.3 Smart Way Group is not responsible for losses arising from:
- User negligence
- Unauthorized access due to device compromise
- SIM swap or OTP interception outside Smart Way Group control
6. Pricing, Fees, Taxes, and Payments
6.1 All applicable parking fees, service charges, penalties, and taxes (including VAT where applicable) will be displayed before confirmation.
6.2 Payments are processed through licensed and regulated payment service providers in Saudi Arabia.
6.3 Smart Way Group does not store full card or banking details. Payment data is handled by regulated payment providers in accordance with applicable standards.
6.4 Dynamic pricing may apply based on demand, duration, location, Parking Operator rules, or Authority requirements.
6.5 You authorize ParkIn and its payment providers to charge the applicable amount for confirmed services, including extensions, penalties, or applicable fees as displayed.

7. CANCELLATION AND REFUND POLICY
7.1 Reservation Cancellation
Users may cancel a reservation before the scheduled start time, subject to location-specific rules, Parking Operator policies, and Platform configuration.
7.2 Cancellation Charges
Certain locations may apply cancellation fees, administrative charges, or non-refundable service fees.
All applicable charges will be clearly displayed to the User before confirmation.
7.3 No-Show and Overstay
- If the User fails to arrive within the permitted grace period (where applicable), the reservation may be automatically cancelled, and no refund may be issued.
- Overstaying beyond the paid or permitted duration may result in additional charges, penalties, or enforcement actions by the Parking Operator or relevant Authorities.
7.4 Refund Processing
Approved refunds will be returned to the original payment method.
Refund processing time depends on the User’s bank and the payment service provider, and may require additional compliance or verification checks.
7.5 Service Disruption and Operator Failure
If a confirmed service cannot be delivered due to a verified system error, Parking Operator failure, or Platform malfunction, Smart Way Group will arrange an appropriate refund or credit, subject to investigation and applicable rules.
8. Penalties and Enforcement
8.1 You acknowledge that parking violations may result in penalties imposed by:
- Parking Operators
- Municipalities
- Authorities
8.2 ParkIn may display violation-related information if integrated with enforcement systems. However, Smart Way Group does not guarantee the completeness or accuracy of Authority data.
8.3 You remain responsible for all parking violations, fines, and penalties related to your vehicle and parking activity.

9. Integration With Authorities and Third Parties
9.1 ParkIn may integrate with government platforms, municipalities, enforcement systems, payment gateways, mapping providers, and other third-party service providers.
9.2 Smart Way Group is not responsible for service interruptions, delays, or failures caused by third-party systems or Authority-level decisions.
9.3 Certain services may be suspended, modified, or restricted due to regulatory instructions or Authority directives.
10. Service Availability
10.1 Smart Way Group strives to provide reliable and secure services. However, ParkIn may be temporarily unavailable due to:
- Scheduled maintenance
- Upgrades
- Network issues
- Force majeure events
- Third-party system outages
10.2 No guarantee is provided for uninterrupted or error-free operation.
11. Intellectual Property Rights
11.1 All software, systems, designs, trademarks, logos, interfaces, data models, and Platform content are owned by Smart Way Group or its licensors.
11.2 You are granted a limited, non-exclusive, non-transferable, revocable license to use ParkIn for personal and lawful purposes.
11.3 Any unauthorized copying, modification, reverse engineering, resale, or commercial exploitation is strictly prohibited.
12. Privacy and Data Protection (PDPL – KSA)
12.1 Smart Way Group processes personal data in accordance with the Saudi Personal Data Protection Law (PDPL) and other applicable regulations.
12.2 ParkIn may collect and process data including:
- Identity and contact details
- Vehicle information
- Location data (if enabled)

- Booking and payment transaction records
- Device and usage analytics
12.3 Smart Way Group may share limited data with Parking Operators, Authorities, or service providers strictly for service delivery, compliance, enforcement, fraud prevention, and system operations.
12.4 You are responsible for reviewing the ParkIn Privacy Policy (where provided) for additional details.
13. Limitation of Liability
13.1 Smart Way Group is a technology platform provider. Smart Way Group is not responsible for:
- Vehicle damage
- Theft
- Accidents
- Injuries
- Personal losses
- Parking disputes at the facility
- Fines imposed by Operators or Authorities
13.2 To the maximum extent permitted under Saudi law, Smart Way Group’s liability is limited to the amount paid by you for the relevant transaction giving rise to the claim (if any).
13.3 Nothing in these Terms excludes liability that cannot be excluded under applicable Saudi law.
14. Suspension and Termination
14.1 Smart Way Group may suspend or terminate your access to ParkIn at any time without prior notice if:
- You violate these Terms
- Misuse, fraud, or suspicious activity is detected
- Security threats occur
- Authorities require suspension
- Legal or compliance requirements demand it
14.2 Upon termination, your right to use ParkIn will immediately cease.

15. Changes to Terms
15.1 Smart Way Group may update these Terms from time to time.
15.2 Updated Terms will be posted on the Platform and may be effective immediately or from a stated effective date.
15.3 Continued use of ParkIn after changes means you accept the updated Terms.
16. Governing Law and Jurisdiction
16.1 These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia.
16.2 Saudi courts shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the use of ParkIn.
